Meeting:

Jackson planners to weigh housing-mitigation exemption for detached homes up to 3,000 sq ft

The Planning Commission will recommend whether to exempt detached homes up to 3,000 square feet from affordable housing mitigation, a change staff say could reduce Town mitigation-fee revenue by about $45,000 to $70,000 a year.

The Planning and Zoning Commission will consider a Land Development Regulations text amendment (PM26-023) that would exempt detached homes of 3,000 square feet or less from the Town’s affordable workforce housing mitigation requirements, with mitigation triggered only if a home expands beyond 3,000 square feet staff report. Staff also propose tightening the existing “small residential additions” exemption so it applies to attached dwellings and apartments, to avoid overlapping exemptions. The Planning and Building Director recommends approval as presented, and estimates the revenue impact at about $45,000 to $70,000 per year.

The staff report frames this as a consistency move after Teton County raised its exemption threshold from 2,500 to 3,000 square feet to align with the state fast-track permit law that took effect July 1, 2026 county packet. If the Town follows suit, the open question is whether the foregone mitigation revenue shows up later as fewer deed restricted units funded through fees in lieu, or whether the smaller-home incentive actually shifts more projects under the exemption.
