Jackson may expand housing-mitigation exemptions for homes up to 3,000 sq ft
Planning commissioners on Nov. 4 will review a Land Development Regulations change that would broaden the housing-mitigation exemption for small single-family homes, a move staff says would cut fees and simplify permits while reducing contributions to the housing fund.
The Planning and Zoning Commission is set to consider a Land Development Regulations (LDRs) text amendment, PM26-023, that would expand the housing-mitigation exemption for small single detached dwelling units, including aligning the exemption with recent Wyoming legislation aimed at reducing costs for homes of 3,000 square feet or less meeting agenda. In the agenda packet, staff say the change would “reduce fees and simplify the application and permit review process” by increasing the exemption now in LDR Section 6.3.2.C.8 for small residential additions agenda packet.
The record shows the commission has wrestled with the same basic tradeoff before. In 2024, staff brought forward P24-094 to add exemptions for small residential additions and certain nonresidential changes of use, explicitly noting it “would cause some reduction in money going into the affordable housing fund” 2024 staff report. If the Town keeps widening exemptions, it should publish an annual tally of fees waived and units actually built with the savings, so residents can see whether the policy is buying livability or just shrinking the housing fund.
