Meeting:

Planning Commission to weigh 9-month freeze on new manmade waterbodies

On Oct. 12, the Teton County Planning Commission will consider recommending a countywide pause on grading permits for new or expanded manmade waterbodies, extending the current 90-day moratorium into September 2027 with specific exemptions.

The Teton County Planning Commission is set to hear a proposal for a countywide “Temporary Freeze on grading permits for construction of new manmade waterbodies” in unincorporated Teton County Planning Commission Meeting Agenda. In a staff report, Planning Director Chris Neubecker recommends the commission advise the county commissioners to adopt a 9-month freeze starting when the current 90-day freeze expires Dec. 2, 2026, and ending Sept. 2, 2027 (or when new Land Development Regulations take effect) Manmade Waterbodies Temporary Freeze Staff Report. The freeze would also cover land disturbance under 12,000 square feet, and it would exempt stormwater ponds, qualifying agricultural ponds, emergency work, maintenance that does not enlarge a permitted waterbody, and certain revisions to issued, non-expired Grading and Erosion Control permits that do not increase a water feature’s size.

The record shows county commissioners already approved the initial 90-day freeze at a Sept. 3 special meeting, with the vote “all in favor” Special Meeting Minutes. The adopted resolution states “a 90-day freeze is placed on the acceptance” of grading permits for new or modified manmade waterbodies, with limited exemptions Manmade Waterbody 90 Day Freeze Resolution.
