County would exempt homes up to 3,000 sq ft from housing mitigation fees

Commissioners will consider an LDR amendment that would raise the County single-family and ARU exemption from affordable workforce housing mitigation from 2,500 to 3,000 sq ft, a change staff say aligns with Wyoming’s new fast-track permitting law.

Teton County’s Board of County Commissioners is set to consider a Land Development Regulations (LDRs) amendment that would expand the exemption from affordable workforce housing mitigation for detached single-family homes and accessory residential units (ARUs) from 2,500 to 3,000 square feet, meaning more new homes would pay no housing mitigation fee-in-lieu at the building-permit stage FY27 Long Range Work Plan packet.

Planning staff say the 3,000 sq ft number is meant to match Wyoming’s new “Fast Track Permits Act,” which takes effect July 1, 2026, and requires expedited permit timelines for homes under that size. In the Planning Commission staff report, planners estimate that if the county issued 28 permits for 3,000 sq ft single-family homes, the foregone mitigation fees would be about $468,272 (about $16,724 per residence), compared with roughly $1.5 million per year in mitigation fees referenced in the county’s Housing Supply Plan budget table Housing Mitigation Reduction Amendment staff report.
