Jackson adopts annual encroachment permits for downtown parklets

On April 13, 2026, the Jackson Town Council finalized Ordinance A to make parklet encroachment permits annual and clarify the April 30–Oct. 30 operating season, standardizing how downtown businesses renew permission to use public right-of-way.

The Jackson Town Council was scheduled to take up second reading of Ordinance A at its April 13 special meeting, finalizing changes to the town’s Parklet Program in Title 12 (Streets and Other Public Places). The ordinance updates how the town issues parklet encroachment permits and clarifies the operating season for parklets. (Special Town Council Meeting Agenda Packet)

Under the changes, parklet encroachment permits “shall be issued annually,” and each permit authorizes operation only from April 30 to Oct. 30 each year, terminating on Oct. 30 of the applicable year. The ordinance also keeps permits tied to the specific site map and footprint approved with the application. (Special Town Council Meeting Agenda Packet)

Town staff told council the amendments match the direction council already gave on March 16, when it voted to continue the Parklet Program while shifting fee payments to an annual basis. Staff recommended approval at second reading. (Special Town Council Meeting Agenda Packet)
