Jackson to restate deed restrictions for two workforce ownership condos

The Jackson Town Council’s March 16 consent calendar includes two items to amend and restate workforce ownership deed restrictions: one for 105 Mercill Ave. Unit 209 and another for 1257 W. Town/county housing staff previously told elected officials that an “amended and restated” deed restriction is typically recorded when a restricted unit is sold (or otherwise needs a new recorded instrument) so the property’s restriction language aligns with updated Housing Department Rules and Regulations and the current restriction templates. In early 2026, staff brought forward updated “amended and restated” restriction templates that add recital language acknowledging and replacing the original recorded restriction, while otherwise tracking the updated templates approved in late 2025. In that Feb. 2 agenda documentation, staff said the template change is not meant to retroactively rewrite already-recorded restrictions across the program; rather, it provides a standardized updated document to use case-by-case when a unit needs a restatement. The Housing Department also noted templates are intended to support consistent administration and enforceability of deed-restricted housing requirements over time.
