Town, county set to adopt updated 'amended & restated' housing deed templates
At a March 9 special joint meeting, Jackson councilors and Teton County commissioners are scheduled to approve updated “amended and restated” deed-restriction templates used to re-record affordable/workforce housing restrictions when rules have changed.
Jackson Town Council and the Teton County Board of County Commissioners will consider approving updated “amended and restated” deed-restriction templates for regulated affordable and workforce housing at their March 9 special joint meeting.
Housing staff told electeds the templates are meant to be the standard recorded instrument for restricted units, and are used when a property needs to be brought into alignment with newer Housing Department Rules and Regulations by re-recording an updated restriction. The proposed “amended and restated” versions mirror the updated templates adopted Dec. 1, 2025, but add recital language acknowledging the original restriction and that it is being replaced.
If approved, the templates would be used by the Jackson/Teton County Housing Authority and the Jackson/Teton County Affordable Housing Department in future transactions involving re-recordation of restrictions, with the goal of maintaining consistent administration and clarity for owners, buyers, lenders and other parties. See the staff report in the Special Joint Meeting Agenda Packet.
